<p><strong>Credit Card Charge Off?</strong><br />I contacted 2 of my creditors that listed my 2 charge cards as chargeoffs on my <strong>credit report</strong> and I requested that since they have been compensated in full, could they be delete from my report. I was told by them that they could not because they be reported as charged off, I can&#8217;t believe that. Can anyone share me if this is true?</p>
<p><strong>Credit card issue?</strong><br />I recently recieved a credit card amendment stating that my inconstant apr&#8217;s will be increasing from 8.25% points to 27.99% (is this the interest?)due to something they saw on my <strong>credit report</strong> which they&#8217;re not specifing? However I have the right not to adopt this amendment by writing to them, but wouldn&#8217;t common sense communicate them that I don&#8217;t want to pay more? Anyways I&#8217;m merely asking for advice because Idk if this is some form of hidden entry where I&#8217;m better bad leaving things as they are. <p><strong>Credit rating-can one black easy target really hurt you?</strong><br />I have reliable credit except for a default of 1200.00 on a common account which i co-signed for a few years ago. at the time he be my fiance and he totalled his car and the insurance covered everything but 1200 bucks. i never received a communication about this debt-i discovered it when i pulled my own credit report. not long i have be harrassed by a credit agency that is threatening that i&#8217;ll never be capable of finance anything if i don&#8217;t wages this money. quite honestly i probably own the cash but the thought of paying for any more penny of my deadbeat ex&#8217;s debt (i paid bad 2000 that was charged on collective credit cards)makes me sick. i think i&#8217;d almost prefer discouraging credit as long as i can still get student loans. does anyone know roughly student loans and credit? also, when does the 7 years start? from the time of the first missed payment? from the time something is &#8216;charged off&#8217;? or the time something is referred to collections?</p>
<p><strong>credit relieve?</strong><br />i went to the hospital surrounded by 2001. I paid the hospital bill. i looked at my <strong>credit report</strong> and saw a hospital charge. i call the collection agency and they explained to me that i paid the hospital bill but not the doctor&#8217;s services. they said they sent me a missive in 2001 and call me several times. they also stated i called them surrounded by 2004 and told them i would pay them. around that time is when i compensated the hospital. they said it&#8217;s been on my <strong>credit report</strong> since 2002 but removed it and added it fund on in 10/2006. it be never on my credit reprt. i want to pay them but how do i go and get it off my report because i have no clue that i did not pay them.</p>
<p><strong>Credit Report &#8211; how to update information? find out what things are?</strong><br />ok so i just saw my credit report.. and at hand a few things on there that i don&#8217;t know what thay are. approaching. $24 for this and $97 for that. I&#8217;d love to pay them past its sell-by date, if i knew what they heck within were for. and it doesn&#8217;t give a hand that they are from a few years ago.. how do i go around finding out what stuff is?also.. my credit is pretty low. and being that i don&#8217;t enjoy any large debts, i reflect that this may slightly be becuase my information is wrong. It lists me as person at a job i have a few years ago where i made in the region of 25% of what i do now. how do i fix this?THANKS!</p>

<p>Driving under the influence, which is also commonly known as DUI, goes by many names in different states across the country.  For example, the same crime is called driving while intoxicated (DWI) in Texas and called operating under the influence (OUI) in Rhode Island.  No matter what it is called though, drunk driving is illegal in every U.S. state and the consequences can be anything from mild license suspensions and fines to jail time and permanent marks on your criminal record.</p>
<p>Driving under the influence is a crime because it is dangerous, not only to the offender, but also to other drivers using the roads. In fact, the high cost in property and personal damages that it extracts from society every year is part of the reason why the consequences can be so far-reaching and severe.  In addition to suspensions, fines, and jail time drunk driving penalties can also include higher insurance rates, mandatory driving school classes, interlock ignition devices, losing the ability to rent a car and maybe even losing your job if you don&#8217;t have another way to get to work.</p>
<p>Some offenders are so reluctant to face the consequences of breaking DUI laws that they seek the assistance of professional DUI lawyers. Even though some offenders may deserve the consequences in store for them, good legal advisors have been able to create enough reasonable doubt in the minds of jurors to reduce or eliminate the consequences. </p>
<p>With expert knowledge concerning the weaknesses in DUI evidence like physical appearance, driving behavior, sobriety tests and alcohol test, lawyers are able to defend their clients.  For example, DUI lawyers stress the likelihood of human and technical errors in calculating alcohol content as well as alternative causes for incinerating evidence in the case.  After all, the smell of alcohol on a person&#8217;s breath is caused more by the kind of drink they consumed (ex. alcohol-free beers have a strong scent) than the amount of alcohol it contained. And red watery eyes could be the result of fatigue, smoke exposure and allergies rather than drinking.</p>
<p>There may be a few cases in which the defendant really has been unjustly accused, but it is harder to distinguish the innocent from the guilty when they are defended by a skilled DUI lawyer.  Consequently, all might not be lost if you are pulled over for a drunk driving offense.  You just need to find the right lawyer and appeal for a court hearing before your license is automatically suspended.</p>

<p>I was physically assaulted on the property i live at and my vehicle was also stolen the next day.  Before I rented from this place i specifically asked how safe these apartments were as I am a victim of domestic violence and looking for a safe place to live with my children to get away permanently from abuse.  The management lady assured that the apartments were safe and had a 24-hour security officer that patroled the grounds.  This i never saw. Can I sue the apartment management company for damages and for them lying to me about the apartments being a safe place to live and about the security office that never was?   Also, the selling/usage of drugs is very high and just two nights ago a young girl was murdered in the unit across from me.</p>
<p>I would appreciate serious answers only.  This is nothing to joke about.  Thank you.

The only security required by law is locks on doors and windows, lights in common areas, and fences and latches at pools. Generally, every exterior door must have both a keyed and keyless bolting device as well as a door view, and all windows and sliding glass doors must have a latch, pin lock, or security bar. The law requires these devices to be installed at the landlord’s expense. The landlord is responsible for repairs or replacement of these devices during the term of the lease. The tenant must notify the landlord of the need for repair or replacement, and the landlord has a reasonable time to comply, which is usually considered to be one week. If the landlord does not provide the required amount of security, the tenant may: (1) install the security device and deduct the costs from the next month’s rent; (2) terminate the lease if the landlord does not comply within three days after being given a written request by the tenant; or (3) file suit against the landlord and try to obtain a judgment for a court order directing the landlord to install a security device, and recover actual damages, court costs, and possibly attorney’s fees.<br />
There are two instances in which a landlord must provide security measures in addition to those listed above. First, a landlord is responsible if he acts negligently. Negligence generally means not acting as a reasonable person would. For example, if your landlord is aware that there have been shady characters loitering around the complex and fails to provide additional security measures or report it to the police, he may be acting negligently and, as a result, be liable for civil damages. Second, the landlord may have incurred an obligation to provide security under the Deceptive Trade Practices Act if he or she made any false statements about the state of the complex’s security. This law would allow you to recover damages if you were injured as a result of the landlord’s failure to provide the promised security.</p>

The pickup sits in my driveway and not on the street and I use it frequently.  When I asked the enforcement office why they did this they told me that it is a state law.  I do not agree with this and want to now if there is a law and who to contact to start a change.

<p>It could be for several reason&#8217;s, on blocks, jacked up.  You need to talk to the code enforcement people, they have got to tell you why..  Just telling you that its a hazardous vehicle is not a proper answer, you have he right to know!</p>

<p>My question is can I move from Texas to Utah?  Is there anything legally he can do to stop us from moving?  I have a better support system there and will also continue college. Do I have to wait until I live in Utah for 6 months (interstate family law?) in order to file the paperwork to establish paternity and then move on to child support, custody, and  visitation? Please help!

<p>Depends on what Utah state law says.  In Texas, you have to be here for 6 months to establish residency.  But as of right now, in Texas this man has NO rights to this child because there is no legal document stating he is the father.  Right now, he will have to take you to court to establish paternity.  Better move asap because he has six months until you file.</p>

<p>DALLAS &#8212; A surprise court ruling from last week has heated up the gay-marriage debate in the state of Texas. A <a href="http://www.divorcemag.com/TX/">Dallas</a> judge has permitted a gay couple, who had married in another state, to get a divorce even though Texas has banned gay marriage.<br /> Judge Tena Callahan of the Family District Court ruled in favor of the divorce on October 1, reasoning that the ban violated the 14th Amendment of the U.S. Constitution, the right to equal protection. While gay-rights advocates have applauded the decision, opponents are disparaging the ruling.<br /> The two men, known in the media only as J.B. and H.B., married in Cambridge, Massachusetts in 2006 and moved to Dallas after one spouse&#8217;s company transferred him there in 2007. They decided to divorce last January, but found they could only do so in Texas, since Massachusetts only grants divorces to couples living in the state.<br /> &ldquo;It&rsquo;s not fair to make them uproot their lives, move back to another state, wait a year, and then file for divorce,&rdquo; the couple&#8217;s <a href="http://www.divorcemag.com/TX/">divorce lawyer</a>, Peter A. Schulte, told the New York Times after the ruling.<br /> J.B., meanwhile, viewed the decision less in terms of its legal and social ramifications than in a personal way. &#8220;Some have called for this to be a day of victory or a cause for celebration. It is actually a day of great personal sadness, as a chapter to my life ends,&rdquo; he said in a press statement by way of his divorce attorney. &#8220;This is the common ground on which I stand with any person who has faced the end of their marriage.&#8221;<br /> But Texas Attorney General Greg Abbott plans to appeal Callahan&#8217;s decision. Abbott was successful in blocking a civil dissolution of a gay union in 2003.<br /> And the state&#8217;s governor, Rick Perry, supports Abbott&#8217;s position. &#8220;Texas voters and lawmakers have repeatedly affirmed the view that marriage is defined as between one man and one woman,&rdquo; Governor Perry said in a statement. &#8220;I believe the ruling is flawed and should be appealed&#8230; Traditional marriage will be upheld in our state.&#8221;<br /> Jon Nelson, a gay-rights spokesperson in Fort Worth, told the Fort Worth Star-Telegram, &#8220;It&#8217;s a breath of fresh air that some jurist had enough courage to see discrimination for what it is.&#8221;<br /> Currently, the only U.S. states that recognize gay marriage are Massachusetts, Connecticut, Vermont, and Iowa. New Hampshire will follow suit and legalize gay marriage in January.</p>

<p>DUI laws seem to be constantly changing. At any given point, multiple state legislatures may be debating new laws that change how drunk driving is charged, how evidence is collected and what penalties are handed down for convictions.</p>
<p>Consider, in the first three months of 2009:</p>
<ul>
<li>Two states passed new DUI laws (Utah and New Mexico)</li>
<li>New DUI laws went into effect in two other states (Illinois and South Caroilna)</li>
<li>Eight states are currently debating changes to their existing DUI laws (Oregon, Rhode Island, Kentucky, Kansas, Wyoming, Louisiana, Maryland, West Virginia)</li>
</ul>
<p>With drunk driving laws changing so rapidly in so many states, what can you expect if you get pulled over?</p>
<p><strong>During your traffic stop</strong></p>
<p>A police officer must have &ldquo;probable cause&rdquo; in order to pull you over on suspicion of drunk driving. Reasons for a traffic stop may include:</p>
<ul>
<li>Erratic driving, such as swerving in and out of lanes</li>
<li>Failure to stop at a stop sign or red light</li>
<li>Illegal turn</li>
<li>Driving with headlights off</li>
<li>Stopping in the road for no reason</li>
</ul>
<p>Once you have been pulled over, a police officer may ask you to perform field sobriety tests (such as the one-leg stand test). The officer may also ask you to submit to a breath test. Using a small machine, such as a breathalyzer, you breath into a tube and the machine uses the breath sample to gauge blood alcohol content, or BAC.</p>
<p>Some of the new <a href="http://www.totaldui.com/state-laws/default.aspx">DUI</a> laws being considered are making it easier for police officers to get the search warrants needed for a blood sample, used to determine blood alcohol content. Some states are also increasing the penalties for anyone who refuses a breath test.</p>
<p><strong>DUI Penalties</strong></p>
<p>The penalties for drunk driving vary widely from state-to-state. In general, drunk driving sentences for first-time offenders will include:</p>
<ul>
<li>Jail time</li>
<li>Fines</li>
<li>Driver&rsquo;s license suspension</li>
</ul>
<p>Some states DUI punishments may also include:</p>
<ul>
<li>Ignition interlock device use</li>
<li>Community service</li>
<li>Alcohol rehabilitation program</li>
<li>Vehicle seizure</li>
</ul>
<p>The penalties for a DUI conviction increase, sometimes dramatically, for multiple <a href="http://www.totaldui.com/your-drunk-driving-case/arrest/default.aspx">DUI</a> arrests.
