Should I receive time-and-a-half if I work more than 8 hours during one day in New Jersey?
I have two jobs… one in New York and one in New Jersey. My job in New York pays me overtime if I work more than 8 hours in a day. My New Jersey job only pays me overtime if I work more than 40 hours collectively in the one-week span. What is the law that prevents me from getting time-and-a-half in NJ the way I do in NY? Or am I being screwed?
I’ve also worked in both states but not at the same time. The fact that you receive 1.5 in NY and not NJ is only because your employer in NY offers it. Under NY state labor law, time and a half does not apply unless the hours worked in a week exceed 40 hours. This rule is the same as in NJ.
