What will the results be of my underage drinking ticket in New York State?
I was at a party, i had one sip of alcohol, I was clearly not intoxicated. The party had more than 40 kids at it. My friend and I were outside and ran and hid in the back of her vehicle as soon as we saw cops coming. the cops came and checked the vehicle got us out and gave us a ticket for possession of alcohol with intent to consume.( im 18) Then they left with out giving anyone else inside the party tickets. We have a court date as well. Iv never been in trouble and Im in the military, I want to go to Law School. I was wondering if there is a way to get out of the ticket (the car was not mine), or how this will affect my record, my license, and my chances of getting a job in the future.
Should i get a lawyer? Or should i write a letter to the court? Also could I be charged as child because i just turned 18 a month ago?
You are in the military and you were busted for possession of alcohol by an under-aged person in NY State … OUCH!
You really need at least one lawyer! The first round of charges will come from the state of NY … conviction can result in fines of more than $500.00, loss of driving privileges for one year (even if you were not driving when cited for the offense) … and probation or community service. The officer did not have to prove you were drunk, just that you were in possession of alcohol. The smell of alcohol on your breath from that “one sip” was enough.
Once you have settled up with NY State … the military can hit you with charges too! The penalty for those offenses would be determined by a military court or the CO at the base you are assigned to (in the case of “non judicial punishment).
Get a civilian lawyer for the NY charges … and an expert in military law for the possible charges from the military!
