<p>In Austin, Texas parties to a  <b><a href="http://www.lawyer-austin.net/divorce.html">divorce</a></b>  proceeding or suit affecting the parent-child relationship are going to have three kinds of relief in family law cases: temporary restraining orders, or &acirc;&#8364;&#339;TRO&acirc;&#8364;&#8482;s&acirc;&#8364;, temporary injunctions and temporary orders. </p>
<p>Temporary restraining orders are used to maintain the &acirc;&#8364;&#339;status quo.&acirc;&#8364; Under the Texas Family Code, a temporary restraining order may be granted ex-parte without notice to the other party for a period of 14 days. (Ex-parte refers to a situation where only one party appears before the judge.) The petition or motion must &acirc;&#8364;&#339;state what relief the court is being asked to grant.&acirc;&#8364; Furthermore, the petition or motion must state the statutory grounds on which the request is based. By preserving the &acirc;&#8364;&#339;status quo,&acirc;&#8364; the temporary restraining order may stop a party from doing some act. For example: a husband and wife own a house in Austin, which is located in  <b><a href="http://www.lawyer-austin.net/">Travis County</a></b>, Texas.  The husband is filing for divorce, but is afraid that his wife is going to reduce the value of the house or other household property. The husband may ask the Travis County Court for relief by asking the court to temporarily restrain his wife from intentionally, knowingly, or recklessly destroying, removing, concealing, encumbering, transferring, or otherwise harming or reducing the value of the property of the parties, etc.  In Texas, a temporary restraining order may be employed in combination with a suit for dissolution of a marriage, (a.k.a. divorce) or in a suit affecting the parent-child relationship.  A temporary restraining order may be employed to protect a child&acirc;&#8364;&#8482;s safety and welfare, the preservation of property, or to protect one of the parties.  </p>
<p>While a temporary restraining order generally refers to an ex-parte request to maintain the &acirc;&#8364;&#339;status quo&acirc;&#8364; for a short duration of time, a temporary injunction is used to maintain the &acirc;&#8364;&#339;status quo&acirc;&#8364; until the case is resolved.  In other words, a temporary injunction is used to stop a party, (either husband or wife) from doing some &acirc;&#8364;&#339;specified activity&acirc;&#8364; until the case is resolved.  A major difference between the temporary restraining order and a temporary injunction is that a temporary injunction requires notice and a hearing before the Texas court can grant relief. As I said, generally, the temporary injunction is going to remain in effect until there is a final judgment.  However, the temporary injunction may be lifted by another order by the court. Typically, a temporary injunction is used to extend an already existing temporary restraining order. </p>
<p>Temporary orders are regarded differently than temporary restraining orders and temporary injunctions. Temporary orders are regarded as &acirc;&#8364;&#339;non-injunctive&acirc;&#8364; in nature. While, temporary orders are regarded as &acirc;&#8364;&#339;non-injunctive&acirc;&#8364; they may have some mandatory or prohibitory effects.  For example, if one of the parties (either husband or wife)to a suit-affecting the parent-child relationship wants possession and access to a child that constitutes a departure from Standard Possession Order that party must present evidence to the court to justify this variation. One factor to be considered by the court is the child&acirc;&#8364;&#8482;s age. If a child is under the age of 3 then the court may deviate from the Standard Possession Order. That being said, the best interest of the child standard is going to be the courts chief concern when determining conservatorship, possession or access to the child. Furthermore, the parties to a suit affecting the parent-child relationship may request the court to grant an order that echo&acirc;&#8364;&#8482;s an agreement entered into by the parties. </p>

</script></div><h2>Texas Health Insurance &#8211; Texas Moveable Health Insurance Plan</h2>
<p>The laws of Texas health insurance, also known as the portability and the Health Insurance Accountability Act, were established in 1996 by Congress to protect workers and their families to health insurance and establish standards for insurance providers and employers. Title I to protect workers if they change jobs or get fired from a current job. The protection extends to employees as family members. Title II covers a different aspect of the legislation on health insurance, requiring health care facilities, employees, insurance providers and health to meet the standards set nationally. Title II is also known as Administrative Simplification (AS), using electronic data systems in Texas and across the United States to issues of health care much more efficient than in the past. </p>
<p>Title I of the Texas Health Insurance main objective is to change the law on service of public health and retirement income of employees of the Security Act. Under Title I, the providers of health insurance in Texas and across the United States cannot judge eligible workers or not simply based on disability, genetics, or their medical history. Health insurance companies in Texas and other states to be able to impose restrictions on health insurance plans for workers who had pre-existing conditions. However, Title I limits of these restrictions that insurers are allowed to put on benefits for workers who fall into this category. In addition, Title I also prohibits providers of health insurance restrictions on coverage or refuse workers to pre-existing conditions. </p>
<p>Title II of HIPPA was created first for the simplification of administrative rules, which require the Department of Health and Human Services to help promote efficiency and effectiveness of health care system in Texas and all other states. Title II also includes two sets of criminal and civil penalties for those who violate the laws. The Department of Health and Human Services has established five key rules: security, privacy, laws, unique identifiers, and transactions and code sets rules. </p>
<p>The safety rule consists of three sections: administrative, physical and technical. Protective measures administrative guidelines for health care to be met, particularly regarding security issues. The Privacy Rule expands on this, imposing restrictions on disclosure of information concerning a person&#8217;s health care status. The application of the Article sets of sanctions, primarily civil violations and fines for those who have violated HIPAA. The article attributes the unique ten-digit National Provider Identifier number to entities such as hospitals or doctors to promote the effectiveness of the health care system in Texas and across the U.S. Finally, the Code operations and establishes rules cover many aspects of health care such as requests for information on eligibility and benefits and the transmission of information on health care. </p>
<p>The HIPAA originally charged health care facilities at a cost to get &#8220;in conformity&#8221; with the HIPAA. Since its inception, the HIPAA laws have affected research and clinical care. Because HIPAA call for details on many forms, some patients complain that many things are extremely user-hostile. Other studies suggest that the HIPAA privacy rules May have adverse effects on costs and results of health research. The implementation of HIPAA also had effects on clinical care as well. Research shows that health facilities are often uncertain of privacy restrictions, so that May be made for patients as a very reluctant to disclose individual information. </p>
<p>One of the most important areas of HIPAA for those with pre-existing is to cover the requirements in Title I. <p>I&#8217;m wondering because my husband says I am not entitled to half of everything, and he (who has no parenting skills) would have to have my duaghter live with him according to TX laws.  I am currently looking for a job but have been unsuccesful till now, we have been married for 7.5 years, and I became a stay at home mom when we had our daughter (age 3).  I also have strong evidence suggesting he may have cheated some years ago, and recently he was in contact w/ a foreign person making plans of having her come visit this house when my duaghter and I still live here, he had told us we needed to leave the house because of that, but I guess they broke up.  It was a 2 week online relationship.  What can I do?  Are there free lawyers?  How can I get help?

<p>The now infamous Anna Nicole Smith (nee Vickie Lynn Hogan) was born in Mexia, Texas on November 28, 1967. Her colorful, tragic life ended suddenly on February 8, 2007, just a few months after her 39th birthday.</p>
<p>She is remembered in many roles: Playboy Playmate of the Year, stripper, waitress, blonde bombshell, cover girl, model, Marilyn Monroe wannabe, reality show actress, diet product guru, mediocre film star . . .</p>
<p>Troubled by a difficult childhood and haunted by the memory of a father who deserted the family, she dropped out of high school and married Billy Smith at the age of 17. Although the marriage did not succeed, it resulted in the birth of her beloved son, Daniel, in 1984.</p>
<p>Perhaps one of Anna Nicole Smith&#8217;s greatest claims to fame was her marriage to a wealthy Texas oil tycoon, J. Howard Marshall II, in 1994. At the age of 89, he was 63 years her senior. Marshall died in 1995, leaving Anna to contest his estate in court with son, E. Pierce Marshall. The estate was reported to be worth $474 million. Although many people called Anna Nicole Smith a &#8216;gold digger&#8217;, J. Howard actually courted and chased her for years before she finally agreed to marry him.</p>
<p>Her second child, Dannielynn, was born out of wedlock over 11 years later. This happy event was overshadowed by Daniel&#8217;s untimely death due to a drug overdose just 3 days after his sister&#8217;s birth.</p>
<p>Anna made many television appearances in the time following Daniel&#8217;s death, usually accompanied by her lawyer/boyfriend, Howard K. Stern. She was obviously deeply hurt and troubled by her son&#8217;s death.</p>
<p>Unfortunately, she was not fated to mourn in peace. A paternity battle ensued. Howard K. Stern claimed to be Dannielynn&#8217;s father, but ex-boyfriend/photographer Larry Birkhead refuted the claim and filed a paternity lawsuit. Meanwhile, speculation over Daniel&#8217;s death continued &#8211; with many people claiming that Anna Nicole and Howard Stern may have had some deliberate involvement.</p>
<p>February 8, 2007: The media is flooded with reports of Anna Nicole Smith&#8217;s death. As this article is written, the exact cause of her death remains unknown.</p>
<p>She wrote a will prior to Daniel&#8217;s death, leaving her entire estate to her son. This seemed to leave Dannielynn out of the picture. However, when the legal dust settled, it appeared that Anna Nicole&#8217;s baby daughter would actually inherit the estate &#8211; which includes the financial settlement from the Marshall inheritance.</p>
<p>More men surfaced, claiming paternity of Dannielynn &#8211; including Prince Frederick von Anhalt (husband of Zsa Zsa Gabor).</p>
<p>Late into February, 2007, loved ones and relatives were still fighting about where she should be buried. The numerous court battles will likely be remembered with as much controversy and rumor as the O.J. Simpson case.</p>

<p>From where this writer sits, Anna appears to have been a trusting, tormented, beautiful soul &#8211; taken advantage of by the very people she depended on and cared for. Where does it all end? Can she not receive some respite from notoriety and controversy even in death?</p>
<p>Let her rest peacefully now. She deserves respect and solitude. She was a misguided, sweet person who merits some dignity after her journey to the other side. We won&#8217;t forget you, Anna Nicole!</p>

<p>My brother is not married to either girl&#8230;..but he has 3 kids by one girl and 2 by another girl. He doesn&#8217;t make a lot of money, but the mother of his 3 older kids told him he better not give the mother of his other 2 kids any money because she said so and if he does he won&#8217;t see his kids and also Texas Law says your suppose to take care of the first family he made, is this true?? I don&#8217;t think it&#8217;s right if this is true&#8230;..I think he should have to take care of all his kids. Neither mother has filed for child support at this time, this is just what she says. Plz Help!!

<p>Right now, neither mother of any of his children can say much of anything.  IF they don&#8217;t file for child support &#8220;oh well&#8221; on their part.  </p>
<p>Even if he doesn&#8217;t pay child support, the mother&#8217;s of the children have no right to stop him from seeing his children or use it against him.</p>
<p>IF your brother can father all these children then he needs to step up to the plate and go to Family Court and start paying child support.</p>

<p>I was never married to the father of my children. He was agreeing to the terms that I set out, now he wants to go and change them because our 5 year old does not want to see him. She won&#8217;t even go near his apartment door! He does not pay a dime to those children. He is not supposed to have time alone with the children because of uncontrolled sezuires and his girlfriend is the same way! They are on medication for that disorder but they never tell me if and when they go through one or more! I would be endangering the lives of the children. He also lives in a run-down apartment. I barely support the children on a 40-hour a week job and going to night school. What paperwork do I have to file and where, for child support and child custody?

<p>Go to your county&#8217;s Child Support Agency. It&#8217;s in the phonebook. Call or walk-in. If the children are in your care for more than 1/2 the time, he will be required to pay child support. As far as him seeing them, you may have to go to mediation which cost me $100. I didn&#8217;t request it, he did. Actually, he requested it 2 times. Do your best as far as that goes. You do have to cooperate with visitation but only if he&#8217;s looking for the best interest of the child. Which is what the mediator does. However, the mediator will believe what he/she wants from both sides. Be polite. My ex started to get rude and it effected the outcome. I just stayed quiet during his little fit. I hope this helps. Good luck! Don&#8217;t let him bully you out of this either. You&#8217;re fighting for your children&#8217;s rights.</p>
