<p>Some other types of lawyers would be divorce lawyers, employment lawyers, fraud lawyers, medical malpractice lawyers, litigation lawyers, tax lawyers, traffic lawyers, software lawyers and many more.</p>
<p>The above are a few of the common lawyers that people hire on an everyday basis. I would say these are the lawyers that make a major portion of the legal market. There are a few others, which I will cover in a later article.</p>

</script></div><h2>How An Adopted Person Can Find Their Birth Family</h2>
<p>In nearly all States, adoption records are sealed and withheld from public inspection after the adoption is finalized. To maintain the confidentiality of these records, most States have instituted procedures by which parties to an adoption may obtain nonidentifying and identifying information from an adoption record, while still protecting the interests of all parties.</p>
<p><b>Non-Identifying Information</b></p>
<p>Nonidentifying information is generally limited to descriptive details about an adopted person and the adopted person&#8217;s birth relatives. Nonidentifying information may include the following:</p>
<ul>
<li>Date and place of the adopted person&#8217;s birth</li>
<li>Age of the birth parents and general physical description such as eye and hair color</li>
<li>Race, ethnicity, religion, and medical history of the birth parents</li>
<li>Educational level of the birth parents and their occupation at the time of the adoption</li>
<li>Reason for placing child for adoption</li>
<li>Existence of other children born to each birth parent</li>
</ul>
<p>Nearly all States allow the adopted person to have access to nonidentifying information about birth relatives, generally upon written request. The adopted person must be an adult, usually at least 18 years of age, before he or she may access this information. Approximately 37 States and American Samoa have provisions in statute that allow access to nonidentifying information to an adoptive parent or a guardian of an adopted person who is still a minor. Some States allow birth parents access to nonidentifying information, and some States give such access to adult birth siblings. Additionally, States are allowed to charge a reasonable fee for providing the information. Policies on what information is collected and how that information is maintained and disclosed vary from State to State.</p>
<p><b>Restrictions on Release of Nonidentifying Information</b></p>
<p>A few jurisdictions are more restrictive about the release of information from adoption records. New Jersey and Guam require a party to obtain a court order before any information can be released. In Indiana and Pennsylvania, the person whose information is being sought must provide consent before information about him or her can be released. In Colorado, any party to the adoption can request that information not be disclosed.</p>
<p>The statutes in Illinois and Kansas allow the adoptive parents to receive medical and family information about the birth family. In addition, the adoptive parents may request the department to contact the birth parents any time, postadoption, for additional health information when there is a medical need.</p>
<p><b>Identifying Information</b></p>
<p>Identifying information is considered to be data that may lead to the positive identification of an adopted person, birth parents, or other birth relatives. Identifying information includes the current name of the person, but usually also includes an address or other contact information so that adopted persons and birth relatives can use the information to arrange personal contact with one another. The statutes in nearly all States permit the release of identifying information when the person whose information is sought has consented to the release.</p>
<p>A mutual consent registry is one method many States use to arrange the consents that are required for release of identifying information. A mutual consent registry is a system whereby individuals directly involved in adoptions can indicate their willingness or unwillingness to have their identifying information disclosed. Approximately 33 States have established some form of a mutual consent registry. Procedures for mutual consent registries vary significantly from State to State. Most registries require consent of at least one birth parent and an adopted person over the age of 18 or 21, or of adoptive parents of an adopted person who is still a minor, in order to release identifying information. Currently, 26 of the States that have registries require the parties seeking to exchange information to file affidavits consenting to release of their personal information. However, seven States will release information from the registry upon request, unless the affected party has filed an affidavit requesting nondisclosure.</p>
<p>Approximately 22 States allow biological siblings of the adopted individual to seek and release identifying information upon mutual consent. No consent is required for adopted persons in Louisiana and Texas to receive identifying information about birth parents who are deceased. Many States ask a birth parent to specify at the time of consent or relinquishment whether they are willing to have their identity disclosed to the adopted person when he or she is age 18 or 21. If consent is not on file, the information may not be released without a court order documenting good cause to release the information. A person seeking a court order must be able to demonstrate by clear and convincing evidence that there is a compelling reason for disclosure that outweighs maintaining the confidentiality of a party to an adoption.</p>
<p>Some States have imposed some limitations on the release of identifying information. Mississippi and South Carolina require the adopted person to undergo counseling about the possible consequences of contact with his or her family before any information is disclosed. In Connecticut, release of identifying information is prohibited if it is determined that the requested information would be seriously disruptive to any of the parties involved.</p>

</script></div><p><b>Other Methods of Obtaining Consent</b></p>
<p>States that have not established registries may use alternative methods for disclosing identifying information. Search and consent procedures authorize a public or private agency to assist a party in locating birth family members to determine if they consent to the release of information. Some States have a type of search and consent procedure called a confidential intermediary system. In this system, an individual called a confidential intermediary is certified by the court to have access to sealed adoption records for the purpose of conducting a search for birth family members to obtain their consent for contact. Other States use an affidavit system through which birth family members can file either their consent to the release of identifying information or a nonconsent to register his or her refusal to be contacted or to release identifying information. The written permission may be referred to as a consent, waiver, or authorization form.</p>
<p><b>Original Birth Certificate</b></p>
<p>When an adoption is finalized, a new birth certificate for the child is customarily issued to the adoptive parents. The original birth certificate is then sealed and kept confidential. In the past, nearly all States required a court order for adopted persons to gain access to their original birth certificates. In approximately 28 States, the District of Columbia, American Samoa, Guam, and Puerto Rico, a court order is still required to gain access to the original birth certificate, but in many States, the laws are changing to allow easier access to these records. Some of the methods now available include:</p>
<ul>
<li>Available through court order when all parties have consented</li>
<li>Available upon request to the adult adopted person</li>
<li>Available upon request to the adopt adopted person unless the birth parent has filed an affidavit denying release of confidential records</li>
<li>Available to persons who have established their eligibility to receive identifying information through a State adoption registry</li>
<li>Available when consents to release of identifying information from the birth parents are on file.</li>

</script></div><h2>New Identity Theft Protection Service For Texas Residents, Banks and Retailers</h2>
<p>Identity theft is on the rise, and is fast becoming one of the top five most often occurring crimes. This crime cost victims, money and time, as well as in some cases even further damages to their health and family. In many instances, it can take up to 400 hours to be resolved, with monetary damages measuring at $5,000.00.</p>
<p>Many states have taken steps to help protect consumers from identity theft, as well as to assist them in recovering. There are now special investigative units within many police departments, as well as State Attorney Generals. However, the state of Texas has recently passed new legislation to help victims of identity theft overcome one of the most significant problems with identity theft that of bank (checking) account theft. Thousands of people each year have had checking accounts opened in their names, checks drawn on the account and thousands of dollars spent, committing identity theft in the form of check fraud.</p>
<p>In the past, check fraud and identity theft victims believed that by simply closing the accounts, after the crime has been discovered, would be enough to stop the unauthorized use of their identity and the account. However, banks had no way of sharing the information about closed accounts with check verification companies that merchants use to determine if checks are legitimate. Identity thieves could use victim&#8217;s checks on an account for weeks even though the owner had closed the account and merchants believed they had a reliable system for verifying accounts. This left many retailers with &#8220;bad checks&#8221; and gave the thieves the opportunity to cash in on this weakness in the banking system.</p>
<p>The Texas Department of Banking adopted the Closed Account Notification System, or CANS, in March 2008. It is believed that this form of protection against identity theft for banks, individuals and retailers is the first of its kind. Representative Helen Giddings (Dallas) authored House Bill 2002, resulting in this protection system and service.</p>
<p>House Bill 2002 requires banks and credit unions in Texas to submit information concerning suspected compromised bank accounts to a secure electronic notification system at a customer&#8217;s request. This notification then alerts companies who offer check verification, to the potential identity theft and fraudulent use of checks from a specific account.</p>
<p>The use of House Bill 2002 establishes a secure electronic notification system, for consumers, banks and check verification systems. According to Representative Giddings, &#8220;Notification happens by the second business day so that thieves are stopped in their tracks. No longer will identity thieves be able to profit from their crimes by passing bad checks for weeks. Millions of dollars will be saved, but most importantly, stopping identity theft early will help victims restore their credit and good name.&#8221;</p>
<p>The new law gives financial institutions additional options to help customers when identity theft or fraud has compromised their accounts. In addition to closing any compromised deposit accounts, the customer may ask the financial institution to send a notice to all major check verification companies.</p>
<p>In order to for consumers to use this service, they must request the action through their bank. It does not happen without their request. Additionally, consumers must provide their financial institutions with: a copy of the incident report or police report case number; a sworn, signed statement that the customer has been a victim of identity theft; and<br />
a written, signed authorization allowing the financial institution to submit the account information to CANS.</p>

To participate, banks must register through a secure web page provided by the Texas Department of Banking. So it is not only important for consumers to request these services, but it is important that your banking institution is participating in this service. To determine if you bank is using this service or has registered to participate in this program talk to your branch or contact the Texas Department of Banking.</p>
<p>Each and every transaction that occurs as a result of identity theft adds to the financial and emotional burden experienced by the victim. With each fraudulent check passed, victims and retailers are both left with losses of time and money. This new law will help consumers to stop identity thieves sooner, as well as stop the cycle of future crimes.</p>
<p>Will other states follow the innovations begun by the state of Texas in providing protection from identity theft for their constituents with House Bill 2002? How effective will this service be? This is yet to be seen, but it all starts with the consumer, they must request participating in the notification system and begin the using the services provided to them to counter the effects of the crime of identity theft.</p>

<p>The now infamous Anna Nicole Smith (nee Vickie Lynn Hogan) was born in Mexia, Texas on November 28, 1967. Her colorful, tragic life ended suddenly on February 8, 2007, just a few months after her 39th birthday.</p>
<p>She is remembered in many roles: Playboy Playmate of the Year, stripper, waitress, blonde bombshell, cover girl, model, Marilyn Monroe wannabe, reality show actress, diet product guru, mediocre film star . . .</p>
<p>Troubled by a difficult childhood and haunted by the memory of a father who deserted the family, she dropped out of high school and married Billy Smith at the age of 17. Although the marriage did not succeed, it resulted in the birth of her beloved son, Daniel, in 1984.</p>
<p>Perhaps one of Anna Nicole Smith&#8217;s greatest claims to fame was her marriage to a wealthy Texas oil tycoon, J. Howard Marshall II, in 1994. At the age of 89, he was 63 years her senior. Marshall died in 1995, leaving Anna to contest his estate in court with son, E. Pierce Marshall. The estate was reported to be worth $474 million. Although many people called Anna Nicole Smith a &#8216;gold digger&#8217;, J. Howard actually courted and chased her for years before she finally agreed to marry him.</p>
<p>Her second child, Dannielynn, was born out of wedlock over 11 years later. This happy event was overshadowed by Daniel&#8217;s untimely death due to a drug overdose just 3 days after his sister&#8217;s birth.</p>
<p>Anna made many television appearances in the time following Daniel&#8217;s death, usually accompanied by her lawyer/boyfriend, Howard K. Stern. She was obviously deeply hurt and troubled by her son&#8217;s death.</p>
<p>Unfortunately, she was not fated to mourn in peace. A paternity battle ensued. Howard K. Stern claimed to be Dannielynn&#8217;s father, but ex-boyfriend/photographer Larry Birkhead refuted the claim and filed a paternity lawsuit. Meanwhile, speculation over Daniel&#8217;s death continued &#8211; with many people claiming that Anna Nicole and Howard Stern may have had some deliberate involvement.</p>
<p>February 8, 2007: The media is flooded with reports of Anna Nicole Smith&#8217;s death. As this article is written, the exact cause of her death remains unknown.</p>
<p>She wrote a will prior to Daniel&#8217;s death, leaving her entire estate to her son. This seemed to leave Dannielynn out of the picture. However, when the legal dust settled, it appeared that Anna Nicole&#8217;s baby daughter would actually inherit the estate &#8211; which includes the financial settlement from the Marshall inheritance.</p>
<p>More men surfaced, claiming paternity of Dannielynn &#8211; including Prince Frederick von Anhalt (husband of Zsa Zsa Gabor).</p>
<p>Late into February, 2007, loved ones and relatives were still fighting about where she should be buried. The numerous court battles will likely be remembered with as much controversy and rumor as the O.J. Simpson case.</p>

<p>From where this writer sits, Anna appears to have been a trusting, tormented, beautiful soul &#8211; taken advantage of by the very people she depended on and cared for. Where does it all end? Can she not receive some respite from notoriety and controversy even in death?</p>
<p>Let her rest peacefully now. She deserves respect and solitude. She was a misguided, sweet person who merits some dignity after her journey to the other side. We won&#8217;t forget you, Anna Nicole!</p>

<p>No. What you&#8217;re describing is called &#8220;champerty and maintenance,&#8221; in which a lawyer who has no legal interest in a case brings it anyway.</p>
<p>The case would be dismissed, and the lawyer would be subject to disbarment.</p>

<p>I worked in the Texas child support enforcement program for 15 years.  They remain understaffed.  Every case is a number.  If the case is easy (i.e., easily located non-custodial parent with a well-paying job), it is prepared for court and well prosecuted.  </p>
<p>At one point, each of the child support officers in my office had over 1,500 cases assigned.  Impossible.</p>
<p>There are private attorney who will take your case, perhaps on a contingency contract.  There are companies offering child support enforcement services; their fee is a percentage of money collected.</p>

<p>I was never married to the father of my children. He was agreeing to the terms that I set out, now he wants to go and change them because our 5 year old does not want to see him. She won&#8217;t even go near his apartment door! He does not pay a dime to those children. He is not supposed to have time alone with the children because of uncontrolled sezuires and his girlfriend is the same way! They are on medication for that disorder but they never tell me if and when they go through one or more! I would be endangering the lives of the children. He also lives in a run-down apartment. I barely support the children on a 40-hour a week job and going to night school. What paperwork do I have to file and where, for child support and child custody?

<p>Go to your county&#8217;s Child Support Agency. It&#8217;s in the phonebook. Call or walk-in. If the children are in your care for more than 1/2 the time, he will be required to pay child support. As far as him seeing them, you may have to go to mediation which cost me $100. I didn&#8217;t request it, he did. Actually, he requested it 2 times. Do your best as far as that goes. You do have to cooperate with visitation but only if he&#8217;s looking for the best interest of the child. Which is what the mediator does. However, the mediator will believe what he/she wants from both sides. Be polite. My ex started to get rude and it effected the outcome. I just stayed quiet during his little fit. I hope this helps. Good luck! Don&#8217;t let him bully you out of this either. You&#8217;re fighting for your children&#8217;s rights.</p>
