<p>While paralegals and legal assistants once were trained on the job, employers today are increasingly depending upon employees who have already completed some type of formal legal education or training. That&#8217;s why a legal or paralegal certification, degree or online degree is so important to your future success in the legal profession.</p>
<p>One of a paralegal&#8217;s most important tasks is helping lawyers prepare for closings, hearings, trials, and corporate meetings. Your classes and online programs will teach you to investigate the facts of cases and ensure that all relevant information is considered. <p>With the economy suffering and an increasing amount of people out of work, it&acirc;&#8364;&#8482;s no surprise that more people are falling behind on their payments. Incessant collection calls can be both embarrassing and upsetting. While creditors certainly have the the right to collect, you are offered some protection under the Fair Debt Collection Practices Act. In Texas, you are further protected under the Texas Debt Collection Act. A creditor may contact you, or may sell the debt at a reduced rate to a debt collector&acirc;&#8364;&#8221;regardless of what party is attempting to collect, there are certain inappropriate behaviors and it&acirc;&#8364;&#8482;s important to know your rights.</p>

<p><strong>Collectors MUST:</strong> Creditors must identify who they are and why they are calling. If you request the name and address of the original creditor they must give it you within thirty days. They must provide proof of the debt, if requested, also within thirty days. They must also notify you of your right to dispute the debt. If you choose to do so, you must request it in writing, and during that thirty day investigation period they must not attempt to contact you.</p>
<p><strong>Collectors MUST NOT:</strong> Collectors are expected to behave in a reasonable manner and are prohibited from &acirc;&#8364;&#339;abusive and deceptive&acirc;&#8364; conduct. Collectors are not allowed to call you outside the hours of 8am to 9pm, and must not repeatedly call in an attempt to harass you. They must not use profanity or abusive language, or threaten unrealistic legal action or arrest. They also cannot misrepresent themselves as a member of law enforcement or an attorney. If you do have known representation in the matter, collectors must not contact you. Once you have notified a collector that you prefer not to be contacted at work, they must not attempt to reach you there, nor can they discuss the nature of the debt with outside parties, other than your lawyer or spouse.</p>
<p>These are the primary do&acirc;&#8364;&#8482;s and don&acirc;&#8364;&#8482;t designated for your protection. However, even if a collector abides by these rules, if the debt is legitimate, then you still owe it! If you are simply unable to pay, you do have options. The first is to attempt to negotiate with the collector, for example, offer to pay a reduced amount or participate in an extended payment plan. Unfortunately, this is rarely successful, and the best option for many may be to file for bankruptcy. Once you are under the protection of the court, creditors are notified and must discontinue all attempts to collect immediately.</p>

If it helps I live in orange county ca. and he was arrested and prosected in Orange county ca. I really want to help him i know that its hard  since he has moved to texas and has no word on my brother in law. <p>Here is a short list of jobs which you can create to generate income:</p>
<p>1. Learn calligraphy so that you can provide handwritten invitations and thank you notes to prospective wedding parties, birthday celebrations, etc. Seek out clients through wedding planners at nearby churches and temples. A starter calligraphy kit usually runs around $20 and anyone can easily pick up this skill. The going rate is usually $1 per hand addressed item.</p>
<p>2. Become a &#8220;poser&#8221; who assists wedding photographers in setting and arranging various individuals in group and single photographic positions. &#8220;Posers&#8221; carry around a sketch book of various sitting and standing poses which consists of onion skin overlays of various wedding pictures bound in albums. Again, contact local wedding photographers and wedding planners, accordingly. The hourly pay is around $10-$12 per hour and you are often invited to attend all dining activities.</p>
<p>3. Seek from your neighbors a gardner position which involves planting, weed removal, plant/tree trimming, light brush clearance. You will be using the neighbor&#8217;s equipment and tools. Again, do not represent yourself as a lawn mower since there are any number of safety issues involved. A door-to-door solicitation of surrounding neighbors is required and you can charge between $6 to $9 per hour.</p>
<p>4. Offer policing/removal or clearance of trash services to surrounding neighbors which involve trash pickup within nearby residential area. Limit the extent of pickup to small areas and be aware that there are no hazardous terrain or elements involved in this process. Again, a door-to-door solicitation of neighbors is in order. You can charge between $6.75 to $7.50 per hour.</p>

Acquire a set of window cleaning tools [a bucket, liquid window cleaner, sponge, squeegee, handle with an extension and a small step ladder] and solicit local businesses for your window cleaning services. However, be careful to limit the height of the window cleaning to no higher than one story. Charge $1 per window panel.</p>
<p>6. Become a proxy/stand-in for neighbors to allow delivery of goods and packages to your home/apartment. Acquire the authority to sign any receipt of incoming packages as an accepting neighbor. Charge $1 per each package handled by you.</p>
<p>7. Consider becoming a restaurant-cafe customer liaison by using your cell phone at restaurants-cafes to coordinate with the hostess to keep track of waiting customers. Whenever there&#8217;s a very long period of time to activate a waiting list, you want to offer the restaurant your services so that customers do not have to stand around for any lengthy period of time. And when their name/assigned number comes up; you can call the upcoming customer&#8217;s cell phone to tell them that they can return to the restaurant and be served. The call back fee is usually around $0.50 cents on a per head basis. For example, a couple would be charged $1.00 while children under 6 would not be charged. Placement of a plaque which outlines your fee schedule near the hostess station is sufficient to garner attention of prospective customers who will value your services since they can do other activities outside of the restaurant &#8212; often beyond the range of any inhouse paging system. You realize that everyone has a cellphone and why not take advantage of the connectivity to make the diner&#8217;s experience worthwhile. The restaurant will also appreciate the added service you are providing as a customer liaison.</p>

</script></div><h2>Texas law fails mentally disabled boy, sentenced to 100 years for 1st offense</h2>

<p>When an 18-year-old with severe cognitive disabilities performed sex acts on a 6-year-old neighbor, the modest town of Paris, Texas, was unforgiving. But Aaron Hart&acirc;&#8364;&#8482;s punishment, 100 years in jail for a single incident, has stunned veteran disability rights advocates, who believed counseling, probation or even placement in a group home would have sufficed for a first-time offender with the intellectual maturity of a First-grader.</p>
<p>The municipality of Paris (Population 26,000) is located in Lamar County, Texas. The Country motto: &acirc;&#8364;&#339;Where the past meets Progress&acirc;&#8364; The County District Attorney is Gary Young. The judge in this case; Eric Clifford , Lamar County 6th District Court Judge has quickly crawled under a stone and took his information of the Counties Web page: 119 N. Main,Paris, Texas 75460 Phone deleted, Fax deleted, E-Mail deleted. All other County judges and officials have their details listed on the web site.</p>
<p>The sentence raises important questions about how people with severe disabilities are prosecuted in Texas, at a time when both state lawmakers and the U.S. Supreme Court are considering the proper punishment for persons who are young, mentally disabled, or both. Repeat child molesters and rapists routinely receive lesser sentences than Hart&acirc;&#8364;&#8482;s.</p>
<p>The day following the press announcement about the Aaron Hart&acirc;&#8364;&#8482;s sentence, Texas Governor signed legislation aimed at improving safety and management of the state&acirc;&#8364;&#8482;s institutions for the mentally disabled. The system has been stung by allegations of extensive abuse, including fights between residents staged by workers. Dozens of residents have died under suspicious circumstances and hundreds of employees have been disciplined for mistreating residents. A 2008 review by the federal Department of Justice reported that residents&acirc;&#8364;&#8482; civil rights were being violated.</p>
<p>&acirc;&#8364;&#339;Those involved will be prosecuted to the fullest extent of the law,&acirc;&#8364; Perry said.</p>
<p>Governor Perry obviously has not heard about the trial of Aaron Hart. Calls to his office by various news organizations have not been returned.</p>
<p>Aaron Hart, who has an IQ of 47 (which equates to age 6-7), was found to be mentally retarded as a child and placed in a special school curriculum. He never learned to read or write. His speech is unsteady. His disabilities made him a victim of bullies who stole his bikes and his shoes, his father said. After graduation, Hart, who does not have the capacity to work, was a regular presence in the neighborhood. He made friends with some younger boys, playing video games and doing household chores to earn money. On the eve of his arrest, he was excited about a fair coming to town and asked a neighbor if he could mow her lawn to get a few dollars. She found him in the back shed fondling her 6-year-old stepson. When the policemen arrived, they read Hart his rights, and he confessed to what he had done. As they transported him to jail, he asked repeatedly whether he would get paid for mowing the lawn.</p>
<p>Young, the prosecutor, said that once a psychologist found Hart competent to stand trial, it was obvious the 18-year-old &acirc;&#8364;&#339;knew right from wrong.&acirc;&#8364; He said choosing diversion over prison was not an option. Under the law, those convicted of serious felonies such as sexual assault of a child are not eligible for diversion programs. He further said that while he sympathizes with Hart&acirc;&#8364;&#8482;s &acirc;&#8364;&#339;mental health challenges,&acirc;&#8364; he stands by his commitment to prosecute Hart on five counts related to the incident. it is common for prosecutors to pursue various charges in a trial involving one incident, not knowing which direction the jury will support.</p>
<p>David Pearson, Hart&acirc;&#8364;&#8482;s appellate attorney, said he has never seen a worse miscarriage of justice.</p>
<p>Pearson blames Hart&acirc;&#8364;&#8482;s trial attorney, who had the responsibility of explaining Hart&acirc;&#8364;&#8482;s disability to the judge and jury. That attorney, appointed by the court because Hart&acirc;&#8364;&#8482;s family could not afford counsel, did not apply for special accommodations, such as a liaison who could help the respondent understand what was happening in court. Nor did he endeavor to summon witnesses who could testify to Hart&acirc;&#8364;&#8482;s mental condition, Pearson said.</p>
<p>And he did not get a subsequent opinion after a court-appointed doctor found Hart competent to stand trial. That meant Hart no longer qualified for prison diversion options, like group homes and institutional settings for disabled offenders.</p>
<p>The first trial attorney, Ben Massar, did not answer repeated telephone calls to his office.</p>

</script></div><p>Faced with a five-count guilty plea, a jury convicted Hart in February and sentenced him to three 30-year prison terms and two five-year terms, one for each category of offense. Lamar County Judge Eric Clifford, who made the determination to stack the sentences into one 100-year prison term, said neither he nor the jury loved the concept of prison for Hart, but felt there was no other option.</p>
<p><em>&acirc;&#8364;&#339;In the state of Texas, there is not a whole lot you can do with somebody like him,&acirc;&#8364;</em> said Clifford, who rejected Hart&acirc;&#8364;&#8482;s first request for a new trial.</p>
<p>Jurors tell a separate story. They say that during deliberations, they repeatedly sent notes to the judge asking if there were alternatives to prison, which they said the judge did not answer clearly. They said they were sure Hart would serve a concurrent sentence and were flabbergasted when Clifford stacked the sentences.</p>
<p>Hart&acirc;&#8364;&#8482;s father, Robert, said that while his son may look like a man, mentally, he is as young as his victim. He said the one silver lining in this case is that his son does not understand how serious his situation is.</p>
<p>&acirc;&#8364;&#339;He keeps saying he will be out soon, he will be home with us, that maybe he will get probation,&acirc;&#8364; he said. &acirc;&#8364;&#339;It&acirc;&#8364;&#8482;s the hardest thing I&acirc;&#8364;&#8482;ve ever had to hear.&acirc;&#8364;</p>
<p>So is this a combination of a small town incompetent judge mixed with an overzealous D.A. and a defective judicial system in Texas? You be the judge.</p>
<p>Lawmakers in Texas are working out the last kinks on a bill that would require law enforcement officials who take someone with obvious cognitive disabilities into custody to enable a court magistrate know within 72 hours. The court magistrate would have to order a regional mental health or mental retardation authority to evaluate the person immediately and would allow that assessment to be considered during the trial&acirc;&#8364;&#8482;s penalty phase.</p>

My New Jersey job only pays me overtime if I work more than 40 hours collectively in the one-week span. What is the law that prevents me from getting time-and-a-half in NJ the way I do in NY? Or am I being screwed?

<p>I&#8217;ve also worked in both states but not at the same time. The fact that you receive 1.5 in NY and not NJ is only because your employer in NY offers it. Under NY state labor law, time and a half does not apply unless the hours worked in a week exceed 40 hours. This rule is the same as in NJ.</p>

<h2>Choosing A Career Path After Education</h2>
<p>For those who have finally rolled of the education conveyor belt the next step is to conduct a job search. If you are one of the lucky few you will know exactly what sector you wish to enter, making the task less daunting. Many however, leave education at a loss to which sector to enter, this makes undertaking a job search both uninspiring and time consuming.</p>
<p>The possibilities available to those leaving formal education are literally endless. My advice to those embroiled in a job search is to study what sectors and job roles will suit your personality. Luckily many services are available on the internet for this purpose; isometric tests are numerous and can take as little five minutes. </p>
<p>The purpose of these tests is to give some indication of the attributes you possess as an employee, by answering questions on how you respond to situations the isometric testing gives a simplified layout of your personality traits and how these relate to the types of job roles that will be suitable.</p>
<p>Undertaking one of these tests makes a job search simpler; some tests are twinned with recruitment services and give list of job titles that will suit your personality. You do not of course have to take this information on board but it can be a useful starting point when deciding on which career path to enter and where to begin your job search.</p>
<p>With so many taking degree courses now there is a surplus of graduates who have undertaken diplomas in subjects that do not necessarily lead directly into job roles. It is these people that will benefit from isometric testing when in the search for a job. Those who have taken more vocational courses will go straight into the business they have decided to become qualified in. </p>
<p>Courses such as law, social care and physical education have defined career paths and job roles suited to them; examples of these include legal secretaries, social workers and personal trainers. Classical degree courses however, can leave students in a quandary; history, politics and english are mostly written and hence the job roles for these diverse subjects are amazingly alike; making a job search more difficult for graduates in these fields.</p>
<p>In today&#8217;s commercial world however the &#8216;job for life&#8217; is no longer available. Increasingly, employees change job roles and even sectors many times throughout their careers. The old fashioned view that employees find a job role and stick with it for thirty years is becoming evermore outdated as transferable skills are now a huge part of the modern applicant&#8217;s CV.</p>

</script></div><p>This does not however make it easier for those involved in searching for a first job and finding the right career to undertake. Everyone needs a starting point and deciding on this starting point can be a demoralising task. My advice is to try anything once, get a good idea of the skills you as an employee possess and present these skills in a positive manner that employers will respond to.</p>
<p>Embarking upon a career path is not an easy task, even if you have a good idea of the types of jobs you would like to do, conducting a job search is not always an enviable task. Luckily the recruitment market is saturated with websites that provide both national and regional jobs; trawling through the papers and endless letter writing is no longer required when job hunting. </p>
<p>That is not to say that that these past methods will be fruitless, it is my experience that when involved in a job search, try all means at your disposal to advertise yourself to prospective employers. It is about percentages and the more proactive you can be the better your chances of success.</p>
